            "cont": "Please read these Terms carefully before downloading, installing or using the App. By downloading, installing, accessing, browsing or using the App, you accept and agree to these Terms which bind you legally. If you do not agree to these Terms you are not permitted to use the App and you must immediately cease downloading, installing or using the App.<br/><br/>By downloading the WatER2022 Application, and by clicking the “Accept” button below, User accepts the following Terms of Use.<br/><br/><strong>WatER2022 Application</strong><br/><br/>The owner and operator of the WatER2022 Application (hereinafter the “Application”, the “App”), and the holder of all related rights is SEMMELWEIS Egészségügyi Szolgáltató és Tanácsadó Korlátolt Felelősségű Társaság (legal seat: 1085 Budapest, Üllői út 26., Hungary; company registry number: 01-09-879749; tax ID: 13916974-2-42; statistical number: 13916974-8622-113-01, hereinafter Provider).<br/><br/>The Application is a free-of-charge mobile application software owned and provided by Provider. By downloading and using the App, Users get support during the FINA 2022 WCH, since through the App they can quickly receive information on the location of the nearest Medical Service stations and on how to get there.<br/><br/><strong>Amendments, software upgrades</strong><br/><br/>Provider retains the right to unilaterally amend these Terms of Use, with prior notification to Users. Upon first use of the Application following any amendment having become effective, by clicking the “Accept” button underneath the Amended Terms of Use, User accepts the Amended Terms of Use. If User fails to accept the Amended Terms of Use, User is not allowed to log in to the App.<br/><br/>Provider is entitled to amend, update, or withdraw the Contents, in full or in part, any time, without prior notification.<br/><br/>The purpose of the software upgrades is to extend, fix, and improve the Application, and to inform Users about the availability of new services. By using the Application, User agrees to receive such upgrades, and acknowledges that the implementation of the changes might impact the availability of the App.<br/><br/><strong>Intellectual property rights</strong><br/><br/>The overall image of the App, the compilation, arrangement and editing of the content and the content itself (hereinafter: the Contents), due to their unique and original nature, are copyrighted. The copyright holder is Provider, and as such, Provider is solely entitled to authorise any third party use of the copyrighted material.<br/><br/>It is prohibited to copy, duplicate, republish or distribute the Contents in any format, in full or in part, without Provider’s prior written consent, except for cases when Provider has made a clear and explicit statement to authorise any such use. Further, it is prohibited to create or adapt any material or work, by the use of, or based on the Contents, including in particular making, or providing unauthorised access to, or distributing, or selling any font, icon, button, link, wallpaper, screensaver, text, picture, graphic design, logo, postcard, photo, audio or video recording.<br/><br/>Provider hereby authorises User to download the App to User’s mobile phone free of charge, and thus to receive a one-time right to use the App, which right however excludes the right of duplication, distribution or editing. Any type of commercial use is subject to Provider’s prior written consent. User shall respect all copyrights, and other rights related to the Contents.<br/><br/>The App may contain links to independent third party websites or other applications (\"Third Party Sites\"). Third Party Sites are not under our control, and you agree that we are not responsible for and do not endorse or monitor their content or privacy policies (if any). We expressly disclaim any liability for loss or damage sustained by you as a result of the accessing and use of Third Party Sites.<br/><br/>Any copyright violation may result in civil (Chapter XIII of Act LXXVI of 1999 on Copyright) or criminal (Chapter XXXVII of the Criminal Code) action.<br/><br/><strong>How to use the App</strong><br/><br/>Users can download the Application free of charge from Google Play or the iOS App Store. The service is provided by Provider, in relation to which User undertakes to promptly notify Provider of any potential unauthorised use of User’s User ID. The use of the App may generate data usage!<br/><br/><strong>Exclusion of liability</strong><br/><br/>Provider excludes any liability for the reliability, operability or accessibility of the Application, or for any of the Contents therein proving to be incorrect or not precise, or for any potential health disadvantage caused to Users. Users use the App solely at their own risk and liability, and Provider is not liable for any damage caused by any improper or erroneous use of the Application, or due to the Application being unavailable, or for any material, non-material damage, consequential damage, or any profit loss arising due to the use of the Application. Provider has no liability whatsoever for the activities carried out by the healthcare providers listed in the App.<br/><br/>Provider uses links to third party websites in the Application. However, Provider has no liability whatsoever for contents and websites provided by third parties, and is not liable for any damage caused by the use of such websites. Such websites and their use are subject to the terms of use defined by the third parties.<br/><br/>User hereby acknowledges that Provider is not liable for any error occurring to User’s mobile phone, or for any damage or data loss caused by any virus, or for any unauthorised access to User’s mobile phone, or for any other damage caused by third parties, or occurring due to a Force Majeure event.<br/><br/><strong>Intended use</strong><br/><br/>User is not entitled to use the App for any purpose other than the above. Unlawful or unauthorised activities include, but are not limited to the following:<ul><li>Any modification or reverse coding of any part of the App;</li><li>The use of any automated application, search robot, page search or reverse coding application, or any other application by which it is possible to modify the App or any part thereof;</li><li>Any reformatting or editing of any part of the Application;</li><li>Unauthorised access to any data not intended for User, or logging into a server or user account to which User has no authorisation;</li><li>It is prohibited to examine, spy on or test the vulnerability of the system or the network, or to violate the overall security or the access verification measures of the system without proper authorisation.</li></ul><br/><strong>You agree:</strong><br/><br/>not to use the App in any unlawful manner, for any unlawful or criminal purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the App;<ul><li>not to use the App to record, post or transmit any information that is defamatory, threatening, abusive, offensive, obscene, indecent, discriminatory or is otherwise objectionable or infringes on third party rights;</li><li>not to use the App in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users, or restrict or inhibit any other users from using the App (including by hacking or defacing the App); and</li><li>not to collect or harvest any information or data from the App or our systems or attempt to decipher any transmissions to or from the servers running the App, including, without limitation, by using any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, \"scrape,\" \"data mine\" or in any way gather the App content or reproduce or circumvent the navigational structure or presentation of the App without our prior written consent.</li></ul><br/><strong>Compensation, damages</strong><br/><br/>User shall indemnify Provider for any damage (actual or indirect) caused by any improper use of the Application, or by any breach of these Terms of Use.<br/><br/><strong>Legal disputes</strong><br/><br/>Parties intend to settle any potential disputes arising out of the Agreement via amicable negotiations. If no agreement is reached by Parties within 30 days of the start of such negotiations, Parties agree to submit to the exclusive competence and jurisdiction of the court with territorial jurisdiction at Provider’s legal seat."

            "cont": "The <strong>WatER2022</strong> Application (hereinafter the Application, the App) you downloaded is operated and provided by SEMMELWEIS Egészségügyi Szolgáltató és Tanácsadó Korlátolt Felelősségű Társaság (legal seat: 1085 Budapest, Üllői út 26., Hungary; company registry number: 01-09-879749; tax ID: 13916974-2-42; statistical number: 13916974-8622-113-01, hereinafter Provider).<br/><br/>To use the Application, Users can supply certain personal data via their mobile phone. Provider has no access to such personal data.<br/><br/>The legal basis for data processing is the consent provided by the data owner, pursuant to 5(1) a) of Act CXII of 2011 on Informational self-determination and the freedom of information (hereinafter Infotv.).<br/><br/>Provider is committed to protect User’s personal data, and it is a priority for Provider to respect Users’ right to informational self-determination. Provider takes all necessary security, technical and organisational measures required to ensure data security.<br/><br/>Downloading the App and providing personal data are done voluntarily in all cases.<br/><br/>User acknowledges the fact that User downloaded the App voluntarily, having made an informed decision. The person supplying data is solely responsible for the adequacy thereof. Based on this responsibility, Provider is not liable for any false data provided.<br/><br/><i><strong>Data processing purposes:</strong></i><br/><br/>The use, by Users, of the GPS locator and other information supply services provided by the <strong>WatER2022</strong> Application, the supply of information and special offers to Users by Provider, based on Users’ GPS coordinates.<br/><br/><i><strong>Legal basis for data processing:</strong></i><br/><br/>User’s consent provided pursuant to section 5(1) a) of Act CXII of 2011 on Informational self-determination and the freedom of information, as well as section 13/A(3) of Act CVIII of 2001 on Certain issues related to e-commerce services and information society services (Eker.tv.)<br/><br/><i><strong>Scope of personal data processed:</strong></i><ul><li>User’s GPS coordinates, in order to display locally relevant offers and messages.</li><li>Data on User’s mobile device generated via the use of the services, which are automatically recorded by Provider’s systems through its technical processes.</li></ul><br/>By using the <strong>WatER2022</strong> App in an iOS or Android environment, User gives consent to Provider to maintain anonymised statistics about when certain functions of the App are opened, and about how long the same are used. User’s GPS coordinates will be used to support the Application’s key functions, however, such coordinates will not be stored by Provider.<br/><br/><i><strong>Duration of data processing:</strong></i><br/><br/>Provider processes the data while User’s registration exists.<br/><br/><i><strong>Access to data:</strong></i> in addition to User, only Provider’s staff has access to the data processed, to the extent required to operate the App and the services. Data are processed by Jacsomedia Kft.<br/><br/>By downloading the App, User gives consent to Provider to interlink the data processed to ensure the efficient operation of the system, and for statistical and information purposes. Provider hereby states that the interlinked data do not constitute personal data, given the fact that such data cannot be linked back to the related person. Provider does not supply such interlinked data to any third party, in any form, and such data are solely accessible by Provider’s staff. This provision does not apply when Provider is required to supply data based on a resolution of an authority, or when complying with other official request.<br/><br/>User may request information on the processing of their data, on the methods, duration, timing, and location of the same, or on any activity related to data processing any time, and may report changes to their data any time.<br/><br/>This consent may be withdrawn by User any time. The deletion of the App means the consent is revoked.<br/><br/>The legal remedies available for Users are: litigation, pursuant to Act CXII of 2011, or User may contact the Hungarian National Authority for Data Protection and Freedom of Information (1122. Budapest, Szilágyi Erzsébet fasor 22/C.) regarding any personal data related issue. User may submit any remarks related to data processing to Provider, to the following e-mail address: info@semmelweiskft.hu<br/><br/>Provider deletes the data when requested so by User, when the purpose of data processing no longer exists, when the statutory period for storing the data expires, and when ordered so by a court or other authority.<br/><br/>The Application may include links to websites operated by third parties.
